This is the personal data processing policy applicable to contacts, customers, prospects, and users of TaleMe.

The company TALEME, a simplified joint stock company registered under the SIREN number 931956676, with its registered office located at 165 Avenue de Bretagne, 59000 Lille, represented by Jean-Baptiste SAGOT (hereinafter referred to as "the Company"), is aware of the importance of ensuring the confidentiality of personal data and commits to protecting it in accordance with the regulations in force on the protection of personal data.

This personal data processing policy aims to inform the User (Subscriber), the contact, or the prospect about the commitments and practical measures taken by TaleMe to ensure the protection of your personal data during the use of its website https://www.talemeapp.com (hereinafter referred to as "the Website"), and its mobile application TaleMe (hereinafter referred to as "the Application").

Article 1: Legal Framework

The following provisions concern all personal data processing carried out during the use of the Website and/or the Application, unless otherwise stated in the specific provisions set out below.

TALEME commits to processing personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the GDPR), with French Law No. 78-17 of 6 January 1978 on data processing, files and liberties (as amended) and with all other applicable laws.

If you are located within the European Union, you also have the right to lodge a complaint at any time with the National Commission for Data Protection and Liberties (CNIL), the French authority in charge of data protection issues (https://www.cnil.fr/). However, we would appreciate the opportunity to address your questions before you contact the CNIL. Please do not hesitate to contact us in advance.

Article 3: Data

If you are located outside the European Union, please note that your personal data will be transferred to the European Union and hosted on servers based in the European Union.

If you are located within the European Union, please note that TALEME hosts all data on servers based in the European Union, and works closely with its service providers and ensures that all service providers comply with the GDPR.

You are, however, informed that your data may be disclosed in accordance with a law, regulation, or a decision of a competent regulatory or judicial authority.

We draw your attention to the use of "social network" buttons of type Facebook, Instagram, TikTok, X and Linkedin. The main use of these "social network" buttons is to allow you to be redirected to our page on the corresponding social network. This option is not mandatory. This use may result in the collection of your personal data by the concerned social network.

We invite you to be vigilant and to consult the personal data protection policies of the concerned social network to be aware of the information it collects as well as the purposes of use of your data, including for advertising purposes.

Sometimes, you can directly modify the access and confidentiality settings of your personal data on the social network's website.

The use of these "social network" buttons is at your own initiative and under your full responsibility. TaleMe is not responsible for the processing of your data that may be carried out or may be carried out by these third-party social networks.

Article 4: Retention of Personal Data

Personal data of users will be retained for the duration of the subscription to a TaleMe service and for as long as necessary for the performance of your contract, the fulfillment of our legal and regulatory obligations, and the application of our terms of use and other agreements, including for billing and collection purposes (available on the site www.talemeapp.com)

Upon termination of a subscription without account deletion request, personal data is retained for an indeterminate period as we allow the user to keep their application active and access their story library. TaleMe reserves the right to delete personal data at its discretion in this context.

Upon termination of a subscription with account deletion request, personal data will be deleted from our databases and will no longer be accessible from the TaleMe application.

Personal data of contacts and prospects who do not create an account is retained for three (3) years from the last contact of TaleMe with the contact or prospect. At the end of this period, personal data will be deleted.

Article 5: Rights of the Person Whose Data is Collected

The person whose personal data is collected has the following rights:

  • request access to their personal data, rectification or erasure of such data, or a limitation of processing relating to the data subject (hereinafter referred to as the "data subject"),

  • object to processing,

  • request the portability of their data,

  • withdraw consent at any time, without affecting the lawfulness of processing based on consent granted before the withdrawal of such consent, this right existing exclusively when the processing is based on Article 6 (1) (a), 6 or on Article 9 (2) (a) of the GDPR, that is, on the consent of the data subject to the processing of his/her personal data for one or more specific purposes,

  • not be subject to a decision based solely on automated processing such as profiling,

  • define guidelines regarding the fate of personal data after his/her death,

  • lodge a complaint with the CNIL.

Article 6: Procedure for Exercising Your Rights

Upon receipt of a valid request by email, it will be processed without delay. Sometimes, our response may take more than thirty (30) working days, if your request is particularly complex or if you have made several requests. In this case, we will let you know, and we will keep you informed.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Otherwise, we may refuse to comply with your request in such circumstances.

We may need to request specific information to help us confirm your identity and ensure your right to access your personal data (or to exercise any of the other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to request additional information related to your request to expedite our response.

Article 7: Cookies

In accordance with the recommendations of the CNIL, our cookie retention period is 13 months at the maximum after their first deposit on the user's device, just like the validity period of the user's consent to the use of these cookies.

The lifetime of cookies is extended with each visit. The user's consent will need to be renewed after this 13-month period.

Our site uses cookies offered by Google Analytics and Google Tag Manager. Google Analytics and Google Tag Manager process the data mentioned in their privacy policy:

The data processed by Google Analytics includes the IP addresses of devices used to access the site, but they are not transmitted to us.

Cookies may be used for statistical purposes, including to optimize the services provided to TaleMe users, which includes processing information concerning the frequency of access, the personalization of pages, the operations carried out and the information consulted.

You are informed that TALEME may deposit cookies on your device. A cookie records information relating to navigation on the service (e.g. the pages consulted, the date and time of consultation, etc.) which we may read during your subsequent visits.

If you do not wish for cookies to be used on your device, most browsers allow you to disable cookies through the settings options.

You can also select "Customize" in the cookies banner displayed at the top of our site to choose to allow/refuse certain or all cookies used on our site.

However, you are informed that certain services may no longer function correctly if cookies are refused.

TALEME may collect navigation information via the use of cookies.

Article 8: Security and Protection of Personal Data

We have chosen Google Cloud to host and secure the data of our services.

The data center dedicated to our services is located in Belgium.

The insurance and guarantee programs in terms of security and protection of personal data that we have selected in the AWS services have been subjected to strict SOC1, SOC2 and SOC3 compliance controls by independent international audit organizations.

Data Protection: Google Cloud's infrastructure puts in place effective protection measures to ensure the confidentiality of users, contacts and prospects. All data is stored in highly secured Google Cloud data centers.

More specifically, exchanged data is encrypted with the TLS certificate, between our users and the server.

Google Cloud has a security breach monitoring system and a data breach notification process. It will take care of any confirmed violation of Google Cloud systems and will inform TALEME as soon as possible.

In the event of a personal data breach, TALEME commits to documenting internally personal data breaches and notifying breaches that pose a risk to the rights and freedoms of natural persons to the CNIL within seventy-two hours (72 hours).

In the event that the risks are high, concerned users of TALEME will also be notified without delay as soon as we become aware of the breach.

Only the following identified and authorized teams of TALEME can process your personal data in connection with our services:

  • the User Support Service team,

  • the Technical Service team via the User Support Service for specific support cases,

  • the Marketing Service team.

Article 9: Service Providers

We engage service providers in Europe for the provision and execution of certain services.

We may share personal data concerning you with these service providers as long as they are subject to obligations in compliance with this Privacy Policy and any other confidentiality measure (such as the GDPR) and adequate security, provided that these third parties use your personal data only for our account and in accordance with our instructions.

Article 9: Managing the Relationship with Our Users

The provisions that follow are specific to each type of personal data processing.

Personal Data Processed

We process the following data via the various forms present on the Website and the Application:

  • the user's email address

We also collect, use and share Aggregated Data, such as statistical or demographic data, for any purpose. Aggregated Data may be derived from your personal data but are not considered personal data under law, as these data will not directly or indirectly reveal your identity. For example, we may aggregate data concerning your use of the Website or the Application to calculate the percentage of users accessing a specific feature of the Website or the Application. However, if we associate or connect Aggregated Data with your personal data so that it is directly or indirectly possible to identify you, we will treat the associated data as personal data which will be used in accordance with this Privacy Policy.

On the Application or the Website, we never ask for sensitive data (racial or ethnic information, political opinions, religious or philosophical beliefs, trade union membership, health, sexual orientation), and we advise against entering such data when using the Website or the Application. However, if you choose to include sensitive data in the free comment areas (including health data such as a disability), they will be transmitted as is, under your sole responsibility and at your sole initiative, to our services or partners to process your request.

Purposes

The personal data processing carried out by TaleMe responds to explicit, legitimate and predetermined purposes, and this processing is useful for managing TaleMe subscriptions as well as managing the relationship with our users and sending transactional and marketing messages. In particular, this processing aims to create and ensure the proper management of subscriptions for the managers, users and beneficiaries of TaleMe.

TaleMe ensures that only data strictly necessary for the purposes of the processing carried out is collected and processed.

TaleMe may send you marketing messages. You can object to this at any time by clicking on the unsubscribe link at the bottom of each email or by contacting TaleMe ("Contact Us").

Legal Basis

This processing is necessary for the performance of the contract to which the data subject is party or for the performance of pre-contractual measures taken at the request of the data subject. This processing is based on Article 6 (1) (b) of the GDPR. The request for data has a contractual nature. The data subject is required to provide this data if he/she wishes to use our products or services. If the data subject does not provide the data, he/she will not be able to subscribe to a TaleMe subscription and will therefore not have access to the service.

Change of Purpose

We will only use your personal data for the purposes for which it was collected, unless we reasonably believe that we need to use it for another reason and that reason is compatible with the original purpose. If you would like to understand how the processing of the new purpose is compatible with the original purpose, please contact us.

If we need to use your personal data for a purpose unrelated to the original purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal data without your knowledge or without obtaining your consent, in accordance with the rules indicated above, if required or permitted by law.

Article 10: Managing the Relationship with Our Contacts and Prospects

The processing of personal data is intended for the management of the relationship with our contacts and prospects. This personal data processing is based on the consent of the data subject (Article 6 (1) (a) of the GDPR). The request for data has a contractual nature. The data subject is not required to provide this data. If the data subject does not provide the data or withdraws his/her consent to the processing of the data, he/she will not be able to receive information about our organization, our products and our services.
